Executive order targets mortgage insurance and refinance title costs

The October 22 order asks FHFA to weigh an automated mortgage-insurance cancellation pilot and a nationwide title waiver for refinances, while Freddie Mac's PMMS slipped to 7.32%.

The President signed "Decreasing Housing Costs for the American People" on October 22, and the text is narrower than the headlines. Section 2 lets the FHFA Director, if he determines it serves the Enterprises and the public, direct Fannie Mae and Freddie Mac to pilot periodic automated-valuation reviews that flag borrowers who may qualify to cancel mortgage insurance, and it applies only to loans made after that pilot is set up; servicers would notify borrowers when cancellation may be available. Section 4 would turn the existing title acceptance pilot into a nationwide program for eligible refinances, accepting an FHFA-approved automated title review in place of a lender's title policy, and asks FHFA to consider going above the current 80% LTV limit, waiving appraisals and income re-verification on limited cash-out refinances that lower the payment, and trimming LLPAs on those loans, with the savings passed to the borrower. Section 5 directs USDA and VA to reduce rates on the single-family loans they make directly. Nothing in it carries an effective date. The only numeric deadline is 180 days for a new manufactured-housing task force to send its recommendations, and HUD says Secretary Turner co-chairs that task force with the FHFA Director.

That order is the signed version of the draft Scotsman Guide reported on Tuesday. The other thing that happened after yesterday's edition went out was in bonds: Treasury's 10-year closed Thursday at 4.96%, down from 5.13% on Wednesday, and Mortgage News Daily tied the move to a selloff that spread from funding worries at CoreWeave to bigger tech names. Freddie Mac's weekly PMMS fell to 7.32% from 7.40%, its first decline in two months by Realtor.com's count, though PMMS still reads 0.29 points above a month ago.

The order and the bond rally both point at refinances, but on different clocks. The bond move is here now and only partly priced in: Bankrate's 30-year fixed reads 7.34% this morning, the same as Thursday and down from 7.37% earlier in the week, a 3 bp drift against a 17 bp drop in the 10-year. The order's refinance savings depend on FHFA decisions that have not been made. Two reads on the rate side: National Mortgage News reports KBW telling investors not to bank on the dip because inflation and the Iran conflict can push rates back up, while Mortgage News Daily framed Thursday as bonds picking up the slack from a weak stock market.

For locks, the calendar is the story. Core PCE falls in the October 23–30 window, new home sales in the October 23–26 window, Case-Shiller on October 27, and the Fed meets October 27–28 with a statement at 2:00pm ET on the 28th and no dot plot this time. The next PMMS and jobless claims land October 29. A borrower closing that week is floating straight through a Fed decision, and the 30-year sits 23 bps under its 30-day high of 7.57%, so this morning's pricing is the conversation to have before Tuesday.

On the regulatory side, Treasury published a proposed rule today implementing section 1001 of the 21st Century ROAD to Housing Act, which bars large institutional investors from buying single-family homes subject to exceptions; the rule would define "large institutional investor," clarify the exceptions and set out enforcement, with comments due November 23 under docket TREAS-DO-2026-0529. Six MLSs, including ARMLS, Bridge, Canopy and REcolorado, sued Compass seeking an injunction over cooperation rules and office exclusives, a fight National Mortgage Professional says bears on where buyers find homes and which agents and lenders reach them first. And Bill Ackman told CNBC that releasing Fannie and Freddie from conservatorship before the end of the administration is "absolutely politically critical," a shareholder's view rather than a policy step.
